Conditions of requesting the temporary residence cards for foreigners

Pursuant to Article 36 of the Law on entry, exit, transit and residence of foreigners in Vietnam 2014, as amended by Clause 14 of Article 1 of the Law on entry, exit, transit and residence of foreigners in Vietnam 2019 has the following cases in which temporary residence cards are granted:

Firstly, foreigners who are members of diplomatic missions, consular offices, representative offices of international organizations of the United Nations, intergovernmental organizations in Vietnam and their spouses, children under 18 years of age, assistant along with the term;

Secondly, foreigners entering Vietnam by Visa LV1, LV2, LS, ĐT1, ĐT2, ĐT3, NN1, NN2, DH, PV1, LĐ1, LĐ2, TT.

Dossiers for requesting temporary residence cards for foreigners

Pursuant to Article 37 of the Law on entry, exit, transit and residence of foreigners in Vietnam 2014 (amended and supplemented in 2019) stipulating procedures for granting temporary residence cards. Pursuant to Article 4 of Circular 31 /2015/TT-BCA stipulating the procedures and competence to process temporary residence cards applications, the application dossiers for temporary residence cards will be different for each foreigner, generally including:

1. A written request of the agency, organization or individual that carries out the procedures for inviting or guaranteeing;

2. Application form for temporary residence cards with photo;

3. Valid passport of foreigners;

4. Documents proving the entry purpose of foreigners in accordance with regulations (Work permit, Certificate of being the head of the representative office, member of the Board of Directors and other valuable papers proving eligibility for granting temporary residence cards);

5. 02 photos of size 3×4 cm, white background

Procedure of requesting temporary residence cards for foreigners

Pursuant to Article 4 of Circular 31/2015/TT-BCA stipulating procedures and competence to process temporary residence cards applications:

Step 1: Prepare dossiers in accrodance with regulations;

Step 2: Submit dossiers at the immigration management agency where the inviting or guarantoring agency and organization is headquartered or where the inviting or guarantoring individual resides. The officer receiving the application shall check the legality and content of the application:

– If application is enough và valid, it will be received and printed. The officer will hand over the receipt and set the date of results return.

– If application is not valid, the officer receiving the application shall guide the applicant to supplement the dossier for completeness.

Step 3: The immigration management agencies or competent agencies of the Ministry of Foreign Affairs consider granting temporary residence cards to foreigners within 05 working days from the date of receiving enough dossiers.

Maturity of Temporary residence cards for foreigners

Pursuant to Clause 16 of Article 1 of the Law on entry, exit, transit and residence of foreigners in Vietnam as amended in 2019 stipulating the maturity of temporary residence cards.

Depending on the purpose of the foreigner’s arrival in Vietnam, the temporary residence cards will have its own symbols to indicate the granted object with different terms.

– The duration of the issued temporary residence cards is at least 30 days shorter than the remaining validity of the passport;
– ĐT1 temtorary residence cards has a maximum term of 10 years;
– NG3, LV1, LV2, LS, ĐT2 and DH temtorary residence cards have a maximum term of 05 years;
– NN1, NN2, ĐT3, and TT temtorary residence cards have a maximum term of 03 years;
– LĐ1, LĐ2, and PV1 temtorary residence cards have a maximum term of 02 years;
– Expired temporary residence cards are considered for new issuance.

How will foreigners who do not have temporary residence cards be fined?

Accordingly, pursuant to Article 18 of Decree 144/2021/NĐ-CP issued on December 31st, 2021 stipulating administrative penalties for violations of regulations on exit, entry, transit, residence and travel. Specifically:
“…

6. The fines ranging from VND 15,000,000 to VND 20,000,000 for one of the following violations:

a) Carrying out procedures to invite or guarantee foreigners to enter into, exit from, or reside in Vietnam but failing to comply with the responsibilities as prescribed by the law provisions or making false statements when carrying out such procedures;

b) A foreigner entering Vietnam with the purpose or to participate in the program other than that he/she has stated in the application for his/her visa, temporary residence cards or temporary residence extension;

dd) An agency or organization employing foreigners but failing to carry out procedures for inviting or guaranteeing them for visas or temporary residence cards, other than the cases subject to change of purpose as prescribed by the law provisions.

8. Additional penalties:

a) Confiscation of material evidence and means of administrative violation, for the violations specified at Points b, c and d, Clause 3; Point a, Clause 4; Point a, Clause 5; Point c, clause 6; Points a, d, Clause 7 of this Article;

b) Deportation of foreigners who commit administrative violations specified in Clauses 1, 2, 3, 4, 5, 6 and 7 of this Article.

9. Remedial measures:

Forcible return of illegal profits obtained from committing violations specified at Point c, Clause 3, and Points a and c, Clause 5 of this Article.”

*NOTE: Above are individual penalty levels. The fines imposed on organization are double of the individual levels.

Thus, when there is a violation related to temporary residencec cards being administratively penalized: The administrative fines can be up to VND 20,000,000 (for an individual); and VND 40,000,000 (for an organization) and other additional penalties.
